PRIVACY NOTICE FOR CONSUMERS AND CLIENTS
According to Texas Data Privacy and Security Act, and any other applicable and valid regulations inside the United States of America, we inform you, as Data Controller of your Personal Information, the following:
I. Data Controller for the treatment of your Personal Data.
GRUPO CORTIBOR, INC., with main business address at 3800 N Mesa St. #524, El Paso, Texas 79902 (hereinafter “TELAT”) in its character of Data Controller for the treatment of Personal Data, informs you about the present Privacy Notice (from now on the “Notice”).
II. Personal Data Gathered and Primary Purposes.
TELAT will gather and treat the following personal information indicated on each case, including sensible and financial information from employees. We take special care of your financial and sensible information such as: biometrics, medical and psychological data.
TELAT can gather your Personal Information in different ways: 1) when the natural person provides the Personal Data directly; 2) when they visit our web page or use our online services; and 3) when Telat gathers the information through other means permitted by law.
The personal data we gather and their primary ends are the following:

- 3) Social security number (SSN) or ITIN.
- 4) Employment and personal references.
- 5) Financial Personal Information: Bank Account cover, SWIFTand/or card number; account number, previous and/or current salary.

- 2) To integrate your files as a Client and register you on our systems.
- 3) To verify your identity.
- 4) To verify there is no conflict of independence or interests with any other of our clients.
- 5) To provide the services you hire from us and comply with the contractual obligations.

- 7) To comply with the applicable regulations.
- 8) To gather the necessary data to make the related billing process.
- 9) For the collection process, if applicable.
- 10) To send you information related to our services.

III. Secondary Purposes.
Telat will make use of your Personal Information with the objective of complying with secondary purposes, such as: (i) marketing, publicity or commercial prospecting according to the services we offer, our own or from a third party; (ii) to make statistics.
In case you don’t want your personal information to be treated for these secondary purposes you can communicate it, you can manifest your negative to the treatment of your data for secondary ends through a request sent to the email: protecciondedatospersonales@telat-group.com, where you can specifying which ones are you denying the use.
IV. Accordance with Children’s Online Privacy Protection Act (COPPA).
TELAT declares not to collect or process any personal data belonging to individuals under 18 years of age.
V. Conservation Period.
TELAT will safeguard and treat their Consumers and Clients Personal Data for the maximum conservation periods permitted by the Law only for the compliance each purpose that justify the treatment without never exceeding those periods, except for the cases that require it for legal depositions or a competent Authority such as: administrative, work-related, accountable, fiscal, criminal or commercial matters.
Your Sensible Personal Data will be safeguarded for the minimum period.
Lastly, once the end of treatment is completed, and when there is no legal or regulatory disposition to do otherwise, TELAT will proceed with the cancellation of Personal Data in our possession.
VI. Video Surveillance Security Cameras.
TELAT has video security cameras working 24 hours, every day of the year, in all areas at the offices, work centers and any additional facility (excepting the bathrooms), the previous with the purpose of complying with the safety and protection of all our employees, visitors and facilities. There are visible notices in our offices to inform our visitors and employees of the aforementioned.
TELAT will never share at any moment these recordings with any external person or legal entity, with exception for those cases where the competent Authority requires it.
VII. Personal Data Transference.
TELAT can transfer your Personal Data if required by competent authorities
TELAT informs you your Personal Data can be treated inside or outside the country, by subsidiary national or international companies and/or can be sent to companies that act as Data Processors in the name of TELAT to treat them according to the described ends in the present Privacy Notice or to any other authorized by the Law.
These companies must be compelled with TELAT to use said shared Personal Data only for the compliance of the accorded ends, as well as to not sell them or reveal them, except for those cases authorized by the Law, with Telat’s previous authorization.
Telat transfers the Personal Data of its Collaborators, only to:

Banking Institutions: data will be shared such as: Name, Social Security Number or ITIN, Address; solely for the purpose of payment process of each contracted service.

Competent Authorities: The subjects, entities or authorities for whom the communication of your personal data is mandatory in accordance with the provisions of the laws or orders of the authorities.
VIII. Consumers Personal Data Rights.
You have the right to (1) confirm whether a controller is processing the consumer ’s personal data and to access the personal data; (2) correct inaccuracies in the consumer ’s personal data, taking into account the nature of the personal data and the purposes of the processing of the consumer ’s personal data; (3) delete personal data provided by or obtained about the consumer; (4) if the data is available in a digital format, obtain a copy of the consumer ’s personal data that the consumer previously provided to the controller in a portable and, to the extent technically feasible, readily usable format that allows the consumer to transmit the data to another controller without hindrance; or (5) opt out of the processing of the personal data for purposes of: (A)targeted advertising; (B) the sale of personal data; or (C) profiling in furtherance of a decision that produces a legal or similarly significant effect concerning the consumer.
IX. Consumers Data Privacy Rights Request to Exercise.
TELAT has the following procedure, means and requirements to execute your Personal Data Rights and the removal of consent for the treatment of your personal data:
To provide and attend the request for the execution of the rights according to section VIII and accordance with Sec.A541.051.AA of the Texas Data Privacy and Security Act (“TDPSA”), each Consumer must present a request through a form available on the tab “Consumer Data Privacy Rights Request” placed on the top part of this Privacy Notice, or through an email request addressed to the Data Privacy Officer, through the email: protecciondedatospersonales@telat-group.com with the following information:

Which and precise description of the Personal Data Right you want to execute according to Section VIII.

Full name of the Owner of Personal Data (Consumer).

A copy of the documents that prove the identity of the Owner (current official ID / current Passport), showing both sides.

In case the owner appears through a legal representative: the previous will have to also send, through the same form, the documents that prove the legal representation (e.g. a power of attorney signed by the Owner, the representative and two witnesses, with a copy of the representative’s ID);

Any other element or document that facilitates the localization of the Personal Data;

Indicate the modifications that will be made and/or the limitations of use of the Personal Data and contribute with the documentation that sustains the request.
The requests to execute the Personal Data Right presented according to this section, will be attended in a span no longer than 20 (twenty) business days starting from the date the request was received. If the request proceeds, it will be effective within the following 15 (fifteen) business days from the date the Controller communicates an answer. The timeframes previously referred to can be extended only once for an equal period.
In case the information provided on the requests is inaccurate or insufficient, or the required documents to prove the identity or the legal representation are not attached, Telat, within the following 5 (five) business days of receiving the request, will ask for the rectification of the deficiencies to start the paperwork. This request must be attended by you on the following 10 (ten) business days of the reception, otherwise the request will not be attended. In case the Owner attends the requirements of the information, the timeframe for the Controller to give an answer to the request will start the next business day the Owner has attended the requirement.
X. Appeal Process.
Telat has an appeal process for all decisions or responses regarding the acceptance or rejection of the Personal Data Rights Request.

Provide a detailed description of the reason for disagreement or the grounds for the appeal.
Once this is done, our Legal Department will review your request and provide a response within 30 days.
If your request is deemed ineligible, you retain the right to submit your request directly to the Texas Office of the General Attorney at the following link: https://www.texasattorneygeneral.gov/consumer-protection.

We inform you that we use cookies and other technologies through which it is possible to monitor your behavior as an Internet user on our website, in order to provide you a better user experience when browsing our page, as well as offer you new services based on your preferences. For the security of our employees, Telat manifests to have the most extended and strict administrative, technical and physical security measures, derived by the best international practices for quality and security with the interest to protect your Personal Data against any harm, loss, alteration, unauthorized destruction, use, access or treatment, at the same time we demand these are fulfilled by our allies and business partners, even on the services given to controlling, controlled and/or subsidiary and/or affiliated companies to Telat.
XIII. Privacy Notice Modifications.
Telat reserves the right to make modifications at any time to this Privacy Notice, to actualize it derived from new legal requirements; for our own needs for the products and services we offer; for changes in our privacy practices; changes on the policies; changes on the business model, or for changes on the applicable legal dispositions.
In case there is a substantial change in the Privacy Notice we will notify it through any of the following means:

For our Clients and Cosumers: it will be communicated through email or a notification from the company’s Intranet.
Telat will not be responsible if you don’t receive the notification about the changes on the Privacy Notice for any problem with your email account, for wrong transmission of information or any other cause not attributable to Telat.
